AN ORDINANCE ESTABLISHING THE PROCEDURE FOR RENTAL OF CITY EQUIPMENT AND ESTABLISHING RATES
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OFRICH HILL,MISSOURIAS FOLLOWS:
Article I
Rental Guidelines
Section A. The rental of city equipment shall be made available to any business or citizen with a utility account in good standing within one mile of the city limits of Rich Hill by signing a work order at City Hall.
Section B. Rental of city equipment shall include a designated city employee as operator.
Section C. All rental requests must be approved by the City Superintendent.
Section D. The City ofRich Hillretains the right to reject any request for equipment rental depending on the nature of the request and the available labor to perform the requested job.
Section E. Equipment rental job requests may only be taken for normal work hours, Monday through Friday. There will be no overtime work or work on weekends and holidays.
Section F. In instances of a conflict, use of equipment for work on city property shall take precedence over requests for equipment rental work orders.
Section G. The work order signed by the customer/lessor shall provide for a release of any liability to the City of Rich Hill for performance of requested work, and the customer / lessor of the equipment will further indemnify and hold the City of Rich Hill and its employees harmless from any and all liability arising out of any claims, demands, liabilities, injuries, expenses (including reasonable attorney’s fees and litigation expenses) arising out of the rental and or use of the equipment or the work project on which the equipment was used.
Article II
Rental Rates
Section A. The following city equipment is available for rental as per Article I, Section A at the following hourly rates:
Equipment requiring one operator
Auger Truck $100.00 Backhoe $65.00
Dump Truck $45.00 Tractor/Mower $30.00 Flatbed truck $30.00 Trencher $40.00
Equipment requiring two operators
1 ton bucket truck $100.00 2 ton bucket truck $125.00 Chipper w/ truck $50.00
Subsection 1) Equipment rental shall be for a minimum of 1 hour and in no less than 30 minute increments for rental time after the first hour.
Section B. The following city equipment is available for rental as per Article I, Section A at the following rates per city lot or portion thereof:
Tractor / Mower $50.00
Weed eater $15.00
Section C. Failure to make payment for equipment rental may result in the balance due being added to the customer’s utility billing, if applicable, and shall be subject to utility billing collection procedures.
This ordinance shall be in full force and effect from and after its passage and approval on this 15th day of December 2010.
