AN ORDINANCE ESTABLISHING RATES, DEPOSITS, INSTALLATION, AND DELINQUENCY CHARGES FOR ELECTRICITY PROVIDED BY THE CITY OFRICH HILL: DISCOUNTS FOR ALL ELECTRIC USAGE AND PROHIBITING THE TAMPERING OF ELECTRIC METERS:
BE IT ORDAINED by the Board of Aldermen of the City of Rich Hill, Missouri as follows:
Article 1 Rates
The rate which users shall pay to the City for electricity is as follows:
The first 20 kilowatt hour $.1900 per kilowatt hour
Next 1480 kilowatt hour $.0990 per kilowatt hour
Next 2000 kilowatt hour $.0880 per kilowatt hour
Next 5000 kilowatt hour $.0770 per kilowatt hour
All kilowatt hour in excess of 8500 $.0750 per kilowatt hour
Minimum monthly charge to customer shall not be less than $5.35.
In addition to the charge determined pursuant to the rates provided above, each user shall pay to the City a fuel adjustment charge to be determined each month. The fuel clause adjustment is calculated and sent to the City by the City’s electric supplier.
Article 2 Billings
All charges for electricity as may be provided herein shall be due and payable on the first day of the month following the date of billing.
Article 3 Delinquent Charges
If such charges have not been paid prior to the opening of business hours on the 16th day of each month the user shall pay to the City a delinquency charge in the amount of 10% of the billing.
Article 4 Extensions
A customer may receive one extension per year on that customer’s utility bill. The customer must have an active account with the City of Rich Hill for six (6) months. For the purpose of this Article, a year will be considered to run from January 1st to December 31st. The customer will be required to pay 25% of the bill at the time the extension is given and must pay 25% per week until the bill is paid in full.
Article 5 Disconnection of services and fees
- The City shall disconnect the services of any user who has not paid all charges provided herein by the 20th day of the month following the date of billing.
- If the service of a user is disconnected due to delinquency as provided above the user shall pay to the City, in addition to all other charges provided herein, a fee in the amount of $10.00 for each trip made by the City Electrician before such services shall be reconnected.
- If services need to be turned on after normal business hours there will be an additional $40.00 overtime fee.
- The City of Rich Hill will adopt the National Electrical Code of 1999. The City Superintendent has the right to disconnect services or send a written violation notice for unsafe or improper service connections in compliance with this code. The violation letter will provide the customer a reasonable amount of time for meeting the requirements specified in the letter. Each case may vary due to the area of non-compliance. The council must approve any non-compliance that will take longer than 60 days to complete.
Article 6 MeterReadings
The City will read each meter each month on the 15th day of each month or the closest working day to the 15th. If the meter reader cannot get to the meter for any reason the following steps will be followed.
a. The 1st time the meter reading will be estimated and the user will receive a letter stating the problem.
b. The 2nd time the meter reading will be estimated an additional $50.00 charge and the user will receive a letter stating the problem.
c. The 3rdtime the services will be disconnected and will remain disconnected until the problem is resolved and all the fees for disconnection have been paid.
Article 7 Installation Fees
- Connection fee will be $10.00
- New 100 amp service will be $360.00 above ground $350.00 below ground
- New 200 amp service will be $425.00 above ground $400.00 below ground
- An additional pole will be $150.00
- Upgrade in service from 100-amp service to 200-amp service will be same.
- Any service larger than a 200-amp single phase will cost $150.00 plus the costs of all materials.
- Moving a pole from one location to another location is $200.00
- Upgrading a service or a new service larger than 1 phase, the customer will pay for the cost of the materials minus the cost of the meter plus $50.00. After the customer has been in operation for 90 days the customer will receive a credit for the cost of the materials minus the cost of the meter on their monthly billing in equal installments of no more than $150.00 per month.
- Business requiring a 3-phase transformer, the customer will pay for the cost of the transformer prior to ordering. The City will install the transformer. After the business has been in operation for 90 days the customer will receive a credit for the cost of the transformer on their monthly utility bill in 12 equal installments. The City will assume ownership and maintenance of the transformer. The City will pay the costs of a replacement transformer in case of transformer failure.
Article 8 Deposits
- Before services are connected each electric customer will pay a $125.00 deposit with the City with the following exception.
- Upon the customer’s presentation of deed showing proof of ownership of the property, the payment of a meter deposit will be waived. The deed will not be accepted unless it has been recorded with the Bates County Recorders Office.
- Any person found to have an unpaid bill; past or present, with the City of Rich Hill will be required to pay a meter deposit of $250.00, regardless if they show proof of ownership as stated in 1 (a).
- At such time an electric service is discontinued, either by the request of the user or for delinquency in payment, the deposit for such service shall be applied first to any charges for such service remaining unpaid to the City and the balance, if any, shall be refunded to the customer.
Article 9 Services
- Electric services will be provided only to the individual that signs the original work order or to the owner of a business or industry. Services will not be provided to anyone whose immediate household includes a member who has an unpaid bill.
- It shall be unlawful for any person having an unpaid bill with the City of Rich Hill to obtain utilities service by means of misrepresentation or by making application in the name of another family member or household member. Should anyone so obtain services then the past bill will become due and payable immediately and the balance due will be put on their next monthly utility bill. An unpaid bill is any account of indebtness due to the City ofRich Hillfor utilities services, which has not been paid or satisfied within 60 days.
Article 10 Tampering with Electric Meters
- No person shall, without the consent of the City, unlawfully and intentionally convert to their use or the use of another person from any wire or conductor of the City any portion of the electric current or electricity distributed by the City, or unlawfully and intentionally prevent such current, or any portion thereof, from passing through any meter provided for measuring the same, or unlawfully and intentionally prevent such meter from registering correctly the current passing through it, or aid in any manner the unlawful conversion to his use or the use of another, of any portion of such electric current which should pass through a meter but has been diverted there from or which has been prevented from being correctly registered by a meter provided therefore, or which has been diverted from the wires or conductors of the City.
- The presence at any time on or about the meters, wires or conductors of any device whatsoever which affects the diversion of electric current without the same being measured or registered by the City shall constitute evidence of knowledge on the part of the person, who as owner or lessee or otherwise at the time has the use, custody or control of the room or building where such device exists, of the existence thereof and effect thereof, and shall further constitute evidence of the intention on the part of such person to defraud. The City may install a check meter and in the event that the check meter installed in the customer’s premises registers more current than is registered by the meter installed in the customers premises, such condition shall constitute evidence that such unregistered current has been wrongfully diverted by the customer, and shall further constitute evidence of the intention on the part of such customer to defraud.
- Any person who shall connect or disconnect or in any way molest or tamper with any electric wire or electric meter in the City of Rich Hill without submitting an application to the City Clerk and approved by the City Superintendent shall be guilty of a misdemeanor and subject to a fine not to exceed $500.00 or by imprisonment in the City jail for a term not to exceed 90 days or a combination of such fine and imprisonment. Said person shall also be required to pay for electric service received during the period of time in question based on the average electric usage for the previous three months at that residence. In the event that the usage from the previous three months is not available, usage shall be obtained by installation of a check meter for two weeks. Where the identity of the person who has tampered with a seal, a meter or a wire is not otherwise proven, the consumer to whom the electric service is being furnished through such meter or wire shall be held responsible.
- The City ofRich Hillreserves the right to deny services to any individual who has been convicted of violating the provisions of this ordinance. Furthermore, the City will turn repeat offenders over to the Bates County Prosecuting Attorney for the possibility of charges with the State ofMissouri.
Article 11 All electric service discount
- The City ofRich Hillwill offer a discount on the electricity used by customers, provided that electricity is the only source of energy used.
- The following discount will be allowed in the following amount upon passage of this ordinance: $.0118999999 per kilowatt-hour
- Any customer believing they are eligible for this discount must make an application at City Hall stating the name of the business, if applicable, and the name of the owner (s) and the location. The applicant(s) must also attest to the fact that the energy consumption for the customer is totally electric.
- In situations where the customer has an alternate source of energy consumption for emergency backup in case of an electrical power outage, these special conditions must be stated in the application for the discount.
- In situations where it has been determined that a discount was given to a customer in error, due to the fact that the customer used another source of energy consumption in addition to electricity, then the customer will be required to reimburse the City for the discount which they were given in error.
- If there are any other special conditions or considerations not already addressed in previous sections of this ordinance, the applicant must state them in the application for the discount.
- The City Superintendent or his designated employee will inspect the residence and if no discrepancies are found the discount will be applied to the next billing cycle.
- If the discount is approved the new rates would be as follows:
The first 50 kilowatt hour $.1781 per kilowatt hour
Next 1480 kilowatt hour $.0871 per kilowatt hour
Next 2000 kilowatt hour $.0761 per kilowatt hour
Next 5000 kilowatt hour $.0651 per kilowatt hour
All kilowatt hour in excess of 8500 $.0631 per kilowatt hour
Minimum monthly charge to customer shall not be less than $ 5.35.
Article 12 Security Lights
- A customer may request a security light for their property at the cost of $5.75 per month.
- To install the light the customer must pay the City ofRich Hillthe cost of the light plus 10% for the maintenance and installation of light on an existing pole. If the customer needs a pole the cost of the pole is $150.00.
Article 13 Work Meters
If a customer has an existing account with the City you may receive a two-week work meter to perform any work that may need to be done on a house or property. The cost of the work meter is $25.00 plus the normal electric rates. You can only have two (2) work meters per year.
Article 14 Test Meters
If a customer feels that their meter is reading inaccurately the City will give them a new meter if they pay for the current meter to be tested or the customer can pay $150.00 for a logger to be installed on the meter. The customer must pay the current cost of the meter testing or the logger fees before the new meter or logger will be placed. If the test findings show that the meter has been running incorrectly by at least 1% the testing costs will be refunded to the customer.
All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
This ordinance shall be in force and affect from and after its passage and approval as provided by law.
