AN ORDINANCE PROHIBITING THE PLACEMENT OF MANUFACTURED HOMES UPON PUBLIC STREETS OR ALLEYS AND REQUIRING FOUNDATIONS AND ANCHORING FOR MANUFACTURED HOMES OCCUPIED AS A RESIDENCE WITHIN THE CITY OFRICH HILL,MISSOURIAND REGULATING THE USE OF CAMPERS OR TRAVEL TRAILERS WITHIN THE CITY OFRICH HILL,MISSOURI

BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RICH HILL, MISSOURI, AS FOLLOWS:
SECTION 1. DEFINITIONS. For the purpose of this Ordinance:
a. The term “Manufactured Home”, sometimes referred to as a “mobile home”, shall mean a factory-built structure or structures which, in the traveling mode, is eight body feet or more in width or forty body feet or more in length, or, when erected on site, contains three hundred twenty or more square feet, equipped with the necessary service connections and made so as to be readily movable as a unit or units on site and designed as a dwelling unit or units.
b. The term “Camper”, sometimes referred to as a “travel trailer”, shall mean a factory built structure which, in the traveling mode, has dimensions less than that of a Manufactured Home, and which is designed for human occupation and is capable of movement by being pulled behind a vehicle.
SECTION 2. MANUFACTURED HOMES NOT PERMITTED ON STREETS OR ALLEYS. A Manufactured Home shall not be temporarily or permanently parked or located on any public street or alley.
SECTION 3. MANUFACTURED HOMES USED AS RESIDENTIAL STRUCTURE. The owner and/or occupier of any Manufactured Home that is to be first occupied as a residence within the City of Rich Hill, Missouri on or after June 12, 2007 or relocated for the purpose of residential occupancy from one area within the City of Rich Hill, Missouri to another area within the City of Rich Hill, Missouri on or after January 1, 2008 shall comply with the following requirements:
a. The owner or occupier of any such Manufactured Home must first file an application for and obtain a permit from the City of Rich Hill, Missouri before any such occupancy and/or relocation is permitted, which application shall contain the following information:
(i) The name and address of the owner and occupier of the Manufactured Home;
(ii) The address of the owner and occupier of the Manufactured Home;
(iii) The telephone number of the owner and occupier of the Manufactured Home;
(iii) The year, make and model of the Manufactured Home;
(iv) The address at which the Manufactured Home will be located within the City ofRich Hill; and
(v) Satisfactory evidence that the Manufactured Home bears the proper seal required by the laws of the State of Missouri evidencing compliance with Chapter 700 of the Revised Statutes of Missouri.
b. The Manufactured Home shall not be more than 20 years old and cannot have paint that is chipping or pealing off its side or roof.
c. Double Wide Manufactured Homes shall be supported on a continuous foundation made of load-bearing masonry units laid contiguously in mortar, or supported on a continuous foundation constructed in accordance with the manufacture specifications for the Manufactured Home. The bricks, concrete masonry units, footing, mortar and the construction methods used to build the foundation shall all be in compliance with such building standards as are approved by the City Superintendent. If constructed so that the foundation will support the weight on the longitudinal I-beams under the trailer, an additional masonry wall shall be permanently constructed with mortar along the perimeter. These perimeter walls shall be constructed as continuous walls under the total length of all sides of the trailer to a height equal to the bottom of the trailer.
d. Single Wide Manufactured Homes, not using a continuous foundation as provided for double wide trailers, shall be required to have (I) foundations runners or piers that are at least 15 inches thick and constructed so that the foundation will support the weight on the longitudinal I-beams and (ii) skirting attached to the trailer made of at least 5/16 inch thick cement fiber board or at least 1 ½ inch thick foam backed vinyl.
e. No two or more Manufactured Homes may attach themselves together.
SECTION 4. MANUFACTURED HOMES TO BE ANCHORED. All Manufactured Homes located within the City of Rich Hill, Missouri shall be anchored and tied down in accordance with the requirements of Section 700.065, Revised Statutes of Missouri and the regulations promulgated thereunder.
SECTION 5. SEAL. No person shall maintain or occupy a Manufactured Home manufactured after January 1, 1974 within the City of Rich Hill which does not at all time bear the proper seal required by the laws of the State of Missouri evidencing compliance with Chapter 700 of the Revised Statutes of Missouri.
SECTION 6. CAMPERS. A Camper or Travel Trailer occupied as either a part time or permanent residence within the City ofRich Hillfor more than 90 continuous days shall be placed upon a concrete pad and connected to water, sewer and electric utilities. The concrete pad must be one continuous pad that is two feet longer and wider than the dimensions of the camper or travel trailer.
SECTION 7. VIOLATIONS AND PENALTIES. Violation of any part of this Ordinance shall be a misdemeanor and punishable upon conviction by a fine of not less than one dollar ($1.00) nor more than five hundred dollars ($500.00), and/or up to confinement of not more than thirty (30) days, and each day the violation shall exists shall constitute a separate offense.
SECTION 8. EFFECT OF PARTIAL INVALIDITY. The invalidity of any section, clause, sentence or provisions of this Ordinance shall not affect the validity of any other part of this ordinance, which can be given effect without such invalid part or parts.
SECTION 9. EFFECTIVE DATE. Except as provided herein, this Ordinance shall take effect and shall be in full force from and after its passage and approval as provided by law.
SECTION 10. REPEALS. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
