1284 – Bill No. 272 Bicycles

AN ORDINANCE REGULATING THE USE OF BICYCLES WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF RICH HILL, MISSOURI

 

 

BE IT ORDAINED BY THE BOARD OF ALDERMAN OF THE CITY OF RICH HILL, MISSOURI, AS FOLLOWS:

 

SECTION 1.  DEFINITIONS. 

For the purpose of this Ordinance, the following definitions shall apply.

 

  1. “Bicycle” shall mean a vehicle having two wheels in a tandem arrangement, of which at least one wheel is 16 or more inches in diameter, which is propelled solely be human power, and upon which one or more persons may ride.
  2. “Bicyclist” shall mean a person operating or in actual physical control of a Bicycle, including a person of foot walking a Bicycle. 

 

SECTION 2 RULES OF THE ROAD.

 

  1. A Bicyclist shall keep at least one hand on the handlebars at all times.
  2. An operator of a Bicycle shall not allow their Bicycle or themselves to become attached to any vehicle upon a roadway or sidewalk. 
  3. Except for the equipment provisions required of vehicles underMissourilaw, Bicyclists shall comply with all other traffic laws of the State ofMissouriand the City ofRich Hillfor operating a vehicle including turn signals. 
  4. No Bicycle shall be secured to any fire hydrant.
  5. Every operator of a Bicycle shall ride as near to the right hand curb or edge of the roadway as practicable.
  6. No person shall operate a Bicycle on the sidewalk or in a sidewalk area unless the person is walking beside the Bicycle. 
  7. Operators of Bicycles on a roadway shall ride in single file. 
  8. All Bicycles shall have reflectors placed at the back and front of the Bicycle if they are being ridden after sunset and before sunrise.
  9. All Bicyclists riding after sunset and before sunrise must wear light colored clothing so that they may be visible to other traffic. 
  10. Bicyclist will not be allowed to operate Bicycles uponWalnut Streetwithin the City ofRich Hillbetween sunset and sunrise except to crossWalnut Street. 

 

SECTION 3.  CRIMINAL LIABILITY OF PARENT OR GUARDIAN.

 

A parent or guardian of a child under the age of 18 years of age shall not knowingly allow a child to violate the provisions of this Ordinance.

 

 

SECTION 4.  VIOLATIONS AND PENALTIES.

 

Violation of any part of this Ordinance shall be a misdemeanor and punishable upon conviction by a fine of not less than one dollar ($1.00) nor more than five hundred dollars ($500.00), and / or up to confinement of not more than thirty (30) days. 

 

 

SECTION 5. EFFECT OF PARTIAL INVALIDITY.

 

The invalidity of any section, clause, sentence or provisions of this Ordinance shall not affect the validity of any other part of this ordinance, which can be given effect without such invalid part or parts.

 

SECTION 6.  EFFECTIVE DATE.

 

This Ordinance shall take effect and shall be in full force from and after its passage and approval as provided by law.
