1271 – Bill No. 260 Open Meetings and Records

AN ORDINANCE ADOPTING THE SUNSHINE LAW AS REQUIRED BY SECTION 610.028, RSMo. AND APPOINTING A CUSTODIAN OF RECORDS

WHEREAS, Section 610.023.1, RSMo, provides that a public governmental body is to appoint a custodian to maintain that body’s records and the identity and location of the custodian is to be made available upon request; and

WHEREAS, Section 610.026, RSMo, set forth that a public governmental body shall provide access to and, upon request, furnish copies of public records; and

WHEREAS, Section 610.028.2, RSMo, provides that a public governmental body shall provide a reasonable written policy in compliance with sections 610.010 to 610.030, RSMo, commonly referred to as the Sunshine Law, regarding the release of information on any meeting, record or vote.

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMAN OF THE CITY OF RICH HILL, MO:

1. That the City Clerk be and hereby is appointed custodian of the records of the City of Rich Hill, Missouri and that such custodian is located at City of Rich Hill, City Hall, 120 N 7^th Street, Rich Hill, MO. 64779.  Such designation does not mean that the City Clerk will necessarily have all records in his or her possession, but simply is an indication to whom requests for copies of records and information regarding the City government shall be directed.

2.  That said custodian shall respond to all requests for access to or copies of public record within the time period provided by statue except in those circumstances authorized by statue.  All requests shall be made in writing.  Oral requests, if received by the City Clerk, shall be immediately recorded in written form to document the same.  Any request received by the City Clerk shall be initialed by the clerk, with the date and time of receipt noted. 

3.  That the fees to be charged for access to or furnishing copies shall be as hereinafter provided

1. Copies of records will be 10 cents per page for paper copies 9 by 14 or smaller. 
2. Hourly fee for duplicating copies will the average hourly rate of pay for clerical staff of the City ofRich Hill.
3. Research time will be billed at actual costs.
4. Copies on CD or floppy disk will be $5.00

4. That it is the public policy of the City ofRich Hillthat meetings, records, votes, actions and deliberations of this body shall be open to the public unless otherwise provided by law.

5.  That City ofRich Hillshall comply with sections 610.010 to 610.030, RSMo, the Sunshine Law, as now existing or hereafter amended. 

Effective Date

This ordinance shall be in full force and effect from and after its passage and approval as provided by law.

All ordinances or parts of ordinances in conflict with this ordinance are herby repealed.
