1236 – Bill No. 224 Parks

 

AN ORDINANCE PROHIBITING FIREWORKS, ANIMALS, ALCHOLIC BEVERAGES, AND DRIVING IN PROSPECT PARK (KNOWN AS THE EAST PARK), PARK PLACE (KNOWN AS THE WEST PARK), CITY BALL PARK, AND THE CABOOSE PARK PROVIDING THE HOURS THEREOF, EXCEPTIONS, AND PENALTIES.

Be it ordained, by the Board of Aldermen of the City of Rich Hill, Missouri, as follows:

Article 1  Fireworks

It shall be unlawful for any person to ignite any fireworks in the City parks. 

Article 2  Alcoholic Beverages

It shall be unlawful for anyone to have or consume alcoholic beverage in or at the City parks. 

Article 3 Driving

It shall be unlawful for anyone to drive in the City parks.

Request for permission for driving in the park must be made in writing and approved by the Board of Aldermen.  This rule shall not apply to any city employee acting within the course and scope of his or her employment.

Article 4 Curfew

            It shall be unlawful for any person to enter upon or loiter, idle, wander, stroll, play or remain in the City of Rich Hill’s Prospect Park (known as the East Park), Park Place (known as the West Park), Ball Park, and the Caboose Park between the hours of 12:00 a.m. and sunrise.

            Request for permission to extend beyond the12:00 a.m.curfew must be made in writing and submitted to the office of the city clerk no later than forty-eight hours prior to such time as an extension of the curfew is requested.  Permission to extend the curfew may be obtained from the city clerk’s office only.

Article 5 Animals Prohibited at Public Functions; Exceptions.

a)     Except as set forth in sub-section (b) below, no animal shall be allowed to be present at any function within the City generally open to the public at which ten (10) or more persons are present.

b)     The provision of sub-section (a) above shall not apply to:

                 I.                    Any certified seeing eye dogs, hearing dogs, governmental police dogs, or other certified dogs that are trained to assist the physically handicapped;

               II.                    Any animal that is participating in a pet parade or other exhibition sponsored by the organization that is holding the public function; however, at the conclusion of any such parade or exhibition, the pet shall be removed from the immediate area of the function

Article 6  Violations

Any person, firm or corporation violating this ordinance shall upon conviction be fined in an amount not exceeding $500.00 and court costs or imprisoned.

All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

This ordinance shall be in force and effect from and after its passage.
