AN ORDINANCE PROVIDING FOR THE LICENSING OF MOTOR VEHICLES” PRESCRIBING PENALTIES FOR VIOLATION THEREOF AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE

            BE IT ORDAINED by the Council of the City of Rich Hill, Missouri, as follows:

                        SECTION 1:  DEFINITIONS:  Whenever in this ordinance the following words or terms are used they shall be deemed to have the following meanings:

            MOTOR VEHICLES:  A vehicle compelled by power other than muscular power; but shall not include for the purpose of this ordinance, farm tractors, traction engines, road machinery or any vehicle owned by the federal, state, county or other municipal government or motor vehicles used exclusively outside the limits of the City of Rich Hill and not garaged within the City.

            MOTOR TRUCK:  A motor vehicle designed to transport materials or commodities.

            OWNER: Any person, firm, association, corporation or partnership whose residence is within the City of Rich Hill, owning or renting a motor vehicle or having the exclusive use thereof, under a lease or otherwise, for a period greater than 30 days.

            CITY CLERK: The Council of the City of Rich Hill designates the person holding the office of City Clerk for the City of Rich Hill, Missouri, or their deputy or deputies.

            SECTION 2: REGISTRATION OF MOTOR VEHICLES AND OWNERS;

Certificate: Every resident owner of a motor vehicle, as defined in Section 1 hereof, which shall be driven or operated on any street or highway in the City, shall cause the same to be registered with the City Clerk and shall furnish to the City Clerk the following information:

(a)   A brief description of the motor vehicle including the name of the manufacturer and the model;

(b)  The name, residence and business address of the owner of such motor vehicle;

(c)   The number of the owner’s state license plate.

SECTION 3: ISSUANCE OF CERTIFICATE OF REGISTRATION, RECORD TO BE KEPT: Upon the payment of the license tax provided in Section 4 hereof, it shall be the duty of the City Clerk to issue a certificate of registration for every motor vehicle registered under this ordinance and to keep an accurate record thereof.

            SECTION 4: LICENSE TAX:  Upon the registration of every motor vehicle as in this ordinance provided, the owner thereof shall pay to the City Clerk an annual license tax as follows:

                      All motor vehicles   $3.00      

            Section 5:  LICENSE TAX PRORATION:  PENALTIES FOR LATE PAYMENT:  When the registration of a new motor vehicle or a used motor vehicle is made after the annual registration date or when any owner of a motor vehicle becomes a resident of the City of Rich Hill after such date, the license tax to be paid shall be the same as above.

            All license taxes if not paid on or before the annual registration date as herein provided shall bear a penalty of $1.00 per month or any part thereof such license tax remains unpaid.

            Section 6:  RENEWAL OF REGISTRATION, EXPIRATION DATE:

The registration of motor vehicles and owners as provided herein shall be renewed annually in the same manner and upon the payment of the same annual license tax as provided by this ordinance on the 1st day of May, of each year, on which date all motor vehicle license shall become due and which shall be considered the annual registration date as referred to herein.

Section 7:  THE TRANSFER OF THE OWNERSHIP OF A REGISTERED MOTOR VEHICLE:  All certificates of registration and licenses shall be issued to the individual procuring the same and shall not be transferable.  Upon the transfer of the ownership or sale of any motor vehicle, the certificate of registration and the right to use the license shall expire and the certificate shall be removed at the time of the transfer of possession or within five days thereafter, if the seller shall give the purchaser written permission to use the license for that five day period.  It shall be unlawful for the purchaser or any other person, other than the person to whom such license was issued to have the same after the expiration of such five day period, whether the motor vehicle is in use or not.

Section 8: LICENSE CERTIFICATE:  It shall be the duty of the City Clerk to furnish each owner so registering a motor vehicle, with a license certificate which shall display a number corresponding to the registration number, the words “City of Rich Hill, Missouri”, the year of issue and the expiration date of the license.  The certificate shall be kept in the motor vehicle and produced upon request. It shall be unlawful to fail to have the certificate at any time.

            Section 9:  REPLACEMENT OF MUTILATED OR LOST CERTIFICATE:

Upon a satisfactory showing to the City Clerk that a license certificate has been lost or destroyed, the City Clerk shall issue a substitute license certificate upon the payment of a fee of fifty cents (.50).  Each owner having acquired a license certificate as provided in this ordinance who shall thereafter acquired a new motor vehicle, shall secure an additional license certificate for said newly acquired motor vehicle, and the City Clerk shall issue a license certificate therefore upon the payment of a fee of fifty cents (.50).

            Section 10:  DISPOSITION OF LICENSE FEES:  All moneys derived from license tax in this ordinance provided for, shall be placed in a special fund of this city and shall be expended in the maintenance, cleaning, construction and repair of the streets and highway within the said City of Rich Hill and for no other purpose.

            Section 11:  PAYMENT OF PERSONAL TAXES REQUIRED:  The City Clerk of this City shall not issue to any applicant a license certificate for any motor vehicle to be operated within the limits of said City of Rich Hill, Missouri, unless such applicant has paid to the City all personal taxes which may have been assessed against the property of said applicant and appear upon the personal tax records of such City.

            Section 12:  PENALTIES:  Any owner violating any of the provisions of this ordinance, shall upon conviction be deemed guilty of a misdemeanor and fined not less than one dollar ($1.00) nor more than fifty dollars ($50.00).

            Section 13:  All ordinances or parts of ordinances in conflict with this ordinance are repealed as to such conflicting parts.  This ordinance shall be in full force and effect after its passage by the Council and approved by the Mayor.

            Read three times and passed this 12th day of March 2002.                          .
