0824 – Operation Motor Vehicles Upon City Property

ORDINANCE 824

 

AN ORDINANCE PROHIBITING THE OPERATION OF MOTOR VEHICLES UPON PROPERTY OWNED BY THECITYOF RICH HILL NOT DESIGNEDANDNORMALLY USED AS A TRAFFICWAY FOR MOTOR VEHICLES,ANDESTABLISHING PENALTIES THEREFORE

Be it ordained and enacted by the Council of the City of Rich Hill, Missouri, as follows:

Section 1.  Definitions.  For the purposes of this ordinance, the following words and phrases shall have the meanings respectively ascribed to them as follows:

(a)    Motor Vehicle.  The term motor vehicle shall mean and include any self-propelled vehicle not used exclusively on rails, including farm and garden tractors.

(b)   City Owned Property.  The term City owned property shall mean and include any and all real property owned or leased by the City of Rich Hill, including but not limited to the East and West parks, the baseball field, and medians between divided streets.

(c)    Trafficway.  The term trafficway shall mean and include all streets, alleys and parking areas normally used and designated as such.

Section 2.  All ordinances or parts of ordinances in conflict with this ordinance are repealed upon approval of this ordinance.

Section 3.  It shall be unlawful for any person to drive, operate or propel any motor vehicle, upon City owned property not normally used and designated as a trafficway in the City of Rich Hill.

Section 4.  This ordinance shall not prohibit the use of motor vehicles on City property performing normal maintenance duties, and operated by employees or contractors of the City.

Section 5.  Upon conviction for violation of this ordinance, a person shall be deemed guilty of a misdemeanor and punished as follows:

(a)    For the first offense, a fine of $100.00 or 30 days in the City of Rich Hill’s jail, or both a fine and jail term.

(b)   For the second offense, a fine of $500.00 or 90 days in the City jail, or by both fine and jail term.

Section 6.  Upon conviction for violation of this ordinance, in addition to the penalties set out above, the City shall have the right to recover civil damages for any loss to it caused by the violation of this ordinance.
