AN ORDINANCE VACATING A PART OF THIRTEENTH STREET IN THE RICH HILL TOWN COMPANY’S FIRST ADDITION TO THE CITY OF RICH HILL, MISSOURI; AND VACATING AND CONFIRMING THE ORDINANCES HERETOFORE PASSED VACATING A PART OF THE STREETS AND ALLEYS IN THE RICH HILL TOWN COMPANY’S FOURTH ADDITION TO THE CITY OF RICH HILL, BATES COUNTY, MISSOURI:
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RICH HILL,BATES COUNTY,MISSOURI, AS FOLLOWS:
Whereas, that portion of Thirteenth Street, hereinafter described, as platted by dedication deed in the Office of the Recorder of Deeds of Bates County, Missouri, is not now used, and there is no need for its future use as a portion of said street by the public, and consequently it is deemed expedient and necessary to vacate and discontinue said portion of said street;
Now, therefore, the following described portion of Thirteenth Street is hereby vacated and discontinued and the City of Rich Hill hereby releases all claims thereto for the purposes of public street and highway:
All that part of Thirteenth Street lying being and situate between Blocks 93 and 94 of the Rich Hill Town Company’s First Addition and directly South of Pine Street in said Addition, in the City ofRich Hill,Bates County,Missouri.
And, Whereas, that portion of the following described strip of ground 50 feet wide, Myrtle Street, Twelfth Street, Thirteenth Street and Fourteenth Street, as platted by Dedication Deed in the Office of the Recorder of Deeds of Bates County, Missouri, are not now used, and there is no need for their future use as streets or public highways by the public, and consequently it is deemed expedient and necessary to vacate and discontinue said strip of land and portions of streets; and furthermore, it has been generally assumed and considered that the land wherein the aforesaid strip of ground and streets are situate is not within the limits of the City of Rich Hill, no city taxes having been assessed or paid thereon for more than 35 years last past; and that same were vacated or taken out of the City Limits many years ago but the record of said proceedings cannot now be located.
Now, therefore, the following described strip of ground and portions of Myrtle Street, Twelfth Street, Thirteenth Street and Fourteenth Street are hereby vacated and discontinued, and the City of Rich Hill hereby releases all claims thereto for the purposes of public streets and highways:
That strip of ground fifty (50) feet in width, and running in an Easterly and Westerly direction directly North of and adjacent to Blocks 118, 119 and 120 of the Rich Hill Town Company’s Fourth Addition, from the East line of Eleventh Street on the West to the West line of Fourteenth Street on the East; that part of Twelfth Street, Thirteenth Street and Fourteenth Street, in the aforesaid Fourth Addition, from the North line of Spruce Street to the South line of the aforesaid fifty (50) foot strip of ground; and all that part of Myrtle Street in said Fourth Addition between the West line of said Addition and the West line of Fourteenth Street.
All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed.
This Ordinance shall be in force and effect from and after its passage and approval.
